ECU TUNING — TERMS & CONDITIONS

1. ECU TUNING SERVICES
Octane Exotics Pty Ltd provides ECU and TCU tuning, programming, calibration and related performance services.
Tuning involves modifying vehicle software and/or operating parameters to alter characteristics such as power, torque, boost, throttle response, RPM limits, fuel delivery, ignition timing, transmission behaviour and other vehicle functions.
The exact results of a tune will vary depending on the vehicle, engine condition, modifications, fuel quality, environmental conditions and other factors.
2. OFF-ROAD & TRACK USE ONLY
Unless expressly confirmed otherwise in writing by Octane Exotics, performance ECU/TCU tuning and calibrations supplied by Octane Exotics are intended for closed-course, competition, motorsport, private-property or off-road use only.
The customer is responsible for ensuring that the vehicle is used only in locations and circumstances where the vehicle, its modifications and its calibration are legally permitted.
The customer must not use a vehicle on public roads where the vehicle or its modifications, emissions equipment, software calibration or operating condition do not comply with applicable laws, regulations or vehicle standards.
The customer is responsible for determining whether their vehicle is legal and compliant for its intended use, including checking requirements relating to registration, roadworthiness, vehicle modifications, emissions, insurance and manufacturer warranty.
3. CUSTOMER RESPONSIBILITY
The customer must provide accurate information about the vehicle before tuning.
This includes, where applicable:

Existing modifications

Previous ECU/TCU tuning

Mechanical faults
-
Warning lights
-
Diagnostic fault codes
-
Engine or transmission issues
-
Fuel type
-
Aftermarket performance components
-
Previous repairs or component failures
Octane Exotics relies on information provided by the customer when determining an appropriate tuning strategy.
The customer must notify Octane Exotics of any known issues that could affect the tuning process or vehicle operation.
4. VEHICLE CONDITION & COMPONENT FAILURE
ECU tuning can increase engine and drivetrain operating loads.
Increased power, torque, boost, RPM or other operating parameters may place additional stress on:

Engine components
-
Turbochargers and superchargers
-
Fuel systems
-
Cooling systems
-
Transmission and clutch components
-
Differentials
-
Driveshafts and axles
-
Engine and transmission mounts
-
Sensors and electronic components
-
Other related vehicle systems
Pre-existing wear, damage, poor maintenance or component weaknesses may become apparent following tuning or increased vehicle use.
Octane Exotics does not guarantee that original vehicle components will withstand the increased operating loads associated with performance tuning.
Component failure may occur independently of the tuning service.
5. PERFORMANCE RESULTS
Performance results are not guaranteed unless a specific result has been expressly agreed to in writing.
Actual results may vary due to:

Vehicle condition
-
Engine health
-
Existing modifications
-
Fuel quality
-
Fuel octane
-
Intake and exhaust configuration
-
Environmental conditions
-
ECU/TCU limitations
-
Factory component tolerances
-
Dyno type and testing conditions
Figures shown by Octane Exotics are estimates or measured results where applicable and should not be treated as guaranteed outcomes unless expressly agreed in writing.
6. FUEL REQUIREMENTS
The customer is responsible for using the fuel specified for their tune.
Using fuel with an unsuitable octane rating, incorrect fuel type or contaminated fuel may cause poor performance, engine damage or other vehicle issues.
Octane Exotics is not responsible for damage resulting from fuel that does not meet the requirements specified for the vehicle or tune.
7. ECU & TCU PROGRAMMING
ECU and TCU programming involves electronically modifying vehicle software.
While reasonable care will be taken during the programming process, electronic programming can occasionally fail or require additional diagnostic, recovery or programming procedures.
Possible circumstances include:

Communication failure

ECU/TCU software failure
-
Interrupted programming
-
Battery voltage instability
-
ECU/TCU hardware faults
-
Existing software corruption
-
Security or immobiliser issues
-
Manufacturer software restrictions
Where additional work is required due to circumstances outside Octane Exotics' reasonable control, additional charges may apply where agreed with the customer.
8. BATTERY & ELECTRICAL SYSTEM
The vehicle must have a suitable and adequately charged battery and functioning electrical system before programming.
Octane Exotics may use a battery support or voltage stabilisation device during programming where appropriate.
Octane Exotics is not responsible for failures caused by an existing weak battery, faulty charging system, electrical fault or other pre-existing vehicle electrical issue.
9. FACTORY WARRANTY & INSURANCE
ECU tuning and vehicle modifications may affect manufacturer warranty coverage and insurance.
The customer is responsible for determining the effect of tuning or modifications on their:

Manufacturer warranty
-
Insurance policy
-
Vehicle registration
-
Vehicle compliance
-
Finance or leasing agreement
-
Other contractual or legal obligations
Octane Exotics recommends that customers contact their insurer and vehicle manufacturer before undertaking modifications where applicable.
10. VEHICLE COMPLIANCE
The customer is responsible for ensuring that their vehicle complies with all applicable laws, regulations and vehicle standards for its intended use.
In Western Australia, vehicle modifications may fall into different approval categories, including modifications requiring inspection or engineering approval. Applicable Australian Design Rules and vehicle modification requirements must be considered.
Octane Exotics does not represent that every tune, modification or calibration is suitable or approved for use on public roads.
11. SOFTWARE & TUNING FILES
Any calibration, tuning file, software modification or proprietary tuning strategy supplied by Octane Exotics remains the intellectual property of Octane Exotics or its relevant software/tuning provider unless otherwise agreed.
Customers must not copy, resell, distribute, modify, reproduce or provide tuning files to third parties without written permission.
12. RETURN TO FACTORY / ORIGINAL SOFTWARE
Where applicable, returning a vehicle to its original factory software may require an additional service or charge.
The availability of the original software cannot always be guaranteed, particularly where the vehicle has previously been modified, tuned or programmed by another party.
13. DIAGNOSTIC & RECOVERY WORK
Additional diagnostic, troubleshooting or ECU/TCU recovery work may be required if an issue is discovered during or following programming.
Where additional work is outside the originally agreed tuning service, Octane Exotics will seek customer approval before carrying out chargeable additional work where reasonably practicable.
14. CUSTOMER AUTHORISATION
By proceeding with an ECU/TCU tuning service, the customer confirms that:

They are the vehicle owner or have permission from the vehicle owner to authorise the work.

The information provided to Octane Exotics is accurate to the best of their knowledge.

They have disclosed known faults, warning lights, modifications and previous tuning.

They understand the potential risks associated with performance tuning.
-
They understand that vehicle component failure can occur.
-
They understand that performance results are not guaranteed unless expressly agreed in writing.
-
They understand the intended off-road/track-use restriction where applicable.
-
They have had the opportunity to ask questions before the tuning service is performed.
15. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Octane Exotics will not be responsible for loss or damage arising from:

Pre-existing vehicle faults or component wear
-
Failure of original or aftermarket components
-
Incorrect or unsuitable fuel
-
Undisclosed vehicle modifications or faults
-
Previous tuning or programming
-
Vehicle misuse or abuse
-
Use of the vehicle outside the intended application
-
Use of the vehicle in competition or motorsport
-
Failure to follow tuning or operating recommendations
-
Failure of components that were not designed to withstand the increased operating loads
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or guarantees that cannot legally be excluded under Australian law, including rights and guarantees under the Australian Consumer Law. Consumer guarantees apply to services and cannot simply be excluded by a business's terms and conditions.
16. ACCEPTANCE
By signing the ECU Tuning Waiver & Customer Authorisation Form and proceeding with the requested service, the customer confirms that they have read, understood and accepted these Terms & Conditions.
The customer acknowledges that performance tuning involves inherent risks and voluntarily authorises Octane Exotics Pty Ltd to perform the agreed tuning services.
